Dismissals based on economic reasons or on performance reasons

This seminar will provide you with an updated perspective on the dismissal procedure for economic or performance reasons through recent case-law developments.

The aim of this seminar is to help you better understand the approach of the Luxembourg labour courts in the dismissal procedure, by specifically addressing the following questions:

  • In which case, can I dismiss an employee for "operational requirements of the undertaking"?
  • On which level, in the framework of a group, shall I assess the economic situation to justify a dismissal?
  • How are the thresholds regarding collective dismissals calculated?
  • Under which conditions can I envisage to dismiss an employee who does not achieve his/her objectives or who is deemed incompetent?

The experienced speakers will illustrate in their presentation numerous examples and practical tips. Speakers include:
